State Level Information

Enacted in 1990, the Idaho Public Records Act ensures and governs access to all public documents in the state.

"Every person has a right to examine and take a copy of any public record of this state and there is a presumption that all public records in Idaho are open at all reasonable times for inspection."- Idaho Statute

Any person may request public records in the state of Idaho. According to 9-338 of the Idaho Statues, "Every person has a right to examine and take a copy of any public record of this state".

Court Record Resources

The Idaho State Police Bureau of Criminal Identification (BCI) is responsible for maintaining the state's hub of criminal history information. It is an automated database based on fingerprint arrest records reported from various statewide agencies. The database is accessible online by authorized criminal justice agencies.

These records are also used for non-criminal background checks for the purposes of employment screening and licensure. It is searchable by either name or fingerprint, though only the fingerprint identification is fully reliable due to the potential for use of aliases.

"A person or private agency, or public agency, other than the department, shall not disseminate criminal history record information obtained from the department to a person or agency that is not a criminal justice agency or a court without a signed release of the subject of record or unless otherwise provided by law." - Idaho Code 67-3008 (6)
