State Level Information
In the state of Indiana, the Indiana Access to Public Records Act is the section of laws designed to ensure access to public records of governmental bodies at all levels of government within the state.
"A fundamental philosophy of the American constitutional form of representative government is that government is the servant of the people and not their master. Accordingly, it is the public policy of the state that all persons are entitled to full and complete information regarding the affairs of government and the official acts of those who represent them as public officials and employees. Providing persons with the information is an essential function of a representative government and an integral part of the routine duties of public officials and employees, whose duty it is to provide the information." - Indiana Code 5-14-3-1

Criminal history background checks are required for a variety of positions within the state of Indiana. From foster care workers and other posts that have direct contact with children to a good number of employers who require the background checks to ensure quality and reliability of their employees.
It is important to note that while both fingerprint and name checks are offered, the reliability of a name check is only as good as the information provided. In other words, someone may have used an alias during the arrest phase of the commission of a crime and as such, that crime would not show up on the name record.
