Montana Public Records
State Level Information
Designed to guarantee access to public records, the Montana Public Records Act is a series of laws covers the records of all governmental agencies throughout the state. Montana law guarantees citizens the right to examine documents and other records that the government produces in the course of carrying out public duties.
While the public records law says that citizens are entitled to view or copy public records in Montana, the Constitution states that no person may be denied such records. The Constitution trumps statute, so anyone may request public documents in Montana.

Court Record Resources
The state of Montana maintains a public criminal history record database that allows for electronic access as dictated in Section 44-5-301 of the Montana Code Annotated. The service is limited to Montana public criminal history record information and as such will not contain information on crimes alleged or committed outside of the state of Montana.
44-5-301. Dissemination of public criminal justice information.(1) There are no restrictions on the dissemination of public criminal justice information.
(2) All public criminal justice information is available from the department or the agency that is the source of the original documents and that is authorized to maintain the documents according to applicable law. These documents must be open, subject to the restrictions in this section, during the normal business hours of the agency. A reasonable charge may be made by a criminal justice agency for providing a copy of public criminal justice information.
