A searchable web based database of public documents in the state of South Dakota known as OpenSD is available in compliance with the South Dakota Sunshine Law which assures full and unfettered access to documents in the public domain that are public records of governmental agencies in the state of South Dakota.
According to the law, anyone may request viewing or copies of public records in South Dakota.

Court Record Resources
South Dakota's Computerized Criminal History System (CCH) is comprised of data on individuals who were the subject of arrests for misdemeanor and felonies in the state that go through State courts, per SDCL 23-5-1 and 4, as well as the accompanying incarceration and follow up entries as required. These records are entirely fingerprint based and are available to criminal justice agencies 24/7.
Individuals requesting a criminal history background check for purposes that are other than Criminal Justice related must complete an Authorization and Release form that is signed by the subject and submit the same along with a standard 8x8" fingerprint card in accordance with SDCL 23-5-12 which requires fingerprint identification. Local law enforcement agencies will be able to assist in the procurement and completion of the fingerprint card as required by law.
